1. Acceptance of these Terms

By accessing or using this Website, you agree to be bound by these Terms and by any policies linked from this Website that apply to your interaction with us.

If you do not agree with these Terms, you should not submit an enquiry through the Website. You may still contact our team directly to request information about our showroom services.

3. Purpose of the Website

This Website is a product showcase and consultation-request website. It is intended to help visitors:

  • review general information about mobile phones designed for simpler everyday use;
  • consider features that may be useful for an older person or family member;
  • request contact from our showroom team;
  • arrange an in-store discussion or product demonstration, where available.

No online sale: submitting an enquiry form, selecting a feature or requesting a consultation does not place an order, reserve stock, confirm a price, create a sales contract or process a payment.

Any proposed purchase is discussed separately with our team and is subject to product availability, confirmed specifications, confirmed pricing and the applicable in-store sale process.

4. Consultation enquiries and requested contact

The Website may allow you to provide contact details and request a call or consultation relating to a mobile phone enquiry.

By submitting an enquiry, you confirm that:

  • the information you provide is accurate and belongs to you, or you are authorised to provide it;
  • you are requesting contact in relation to your enquiry;
  • you understand that no purchase is completed through the enquiry form;
  • you will not intentionally submit unlawful, misleading, abusive or harmful content.

We may contact you by telephone, email or SMS to respond to the specific consultation request you submitted. Marketing communications, where offered, are handled separately and subject to any required consent and opt-out arrangements.

We may decline, pause or close an enquiry where we reasonably believe that it is false, abusive, automated, unlawful or unrelated to our showroom services.

5. Product information, images and availability

Product descriptions, feature explanations, photographs, illustrations, accessories, specifications and comparison information displayed on this Website are intended to assist with initial consideration before a consultation.

Before any purchase, you should confirm with our team:

  • the exact handset model available for sale;
  • the current price;
  • the included accessories and any optional accessories;
  • the supported network, SIM, calling and connectivity requirements;
  • the availability of features such as picture contacts, remote assistance, video calling, reminders or charging accessories;
  • any warranty documentation or manufacturer information supplied with the handset.

Product availability and specifications may change. We take reasonable care to present information accurately, but Website content should not be treated as confirmation that a particular product, feature or accessory is currently available unless confirmed by our team.

6. In-store purchases

Products are not purchased through this Website. Where a customer decides to buy an available product after consultation, the sale is completed through the relevant physical store or other expressly confirmed offline sales process.

At or before sale, the customer should be provided with the applicable product price, payment arrangements, receipt or proof of transaction, available warranty information and any relevant in-store returns information.

The fact that a purchase takes place in store rather than online does not remove any consumer rights that apply under Australian law.

7. Australian Consumer Law and consumer guarantees

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

Products and services supplied to consumers may come with statutory consumer guarantees. Depending on the circumstances, a customer may be entitled to a remedy where a product or service does not meet an applicable consumer guarantee.

Your statutory rights remain available. Any voluntary store policy, manufacturer warranty or product information provided by us operates in addition to, and does not replace or limit, rights available under Australian Consumer Law.

Further practical information about returns and available remedies is set out in our Returns, Refunds & Consumer Guarantees Policy .

8. Returns, refunds, repairs and replacements

Because this Website does not process purchases, returns or refund requests are handled in relation to products actually purchased from the store.

If you have purchased a product from us and believe there is a fault, safety issue, misdescription, failure of an important feature or other problem, please contact the store promptly and retain your proof of purchase where available.

The outcome available may depend on the nature of the issue and the applicable consumer guarantee rights. A remedy may include repair, replacement, refund or another legally appropriate solution.

A change-of-mind request may be treated differently from a problem covered by statutory consumer guarantees. Any voluntary change-of-mind policy will be described separately and will not limit statutory rights.

9. Network compatibility, third-party services and accessories

Mobile phones may depend on third-party networks, SIM cards, mobile plans, compatible accessories, applications, internet access or manufacturer-supported services.

Unless expressly confirmed at the time of consultation and purchase:

  • we do not guarantee that a handset will work with a particular mobile provider or plan;
  • we do not guarantee ongoing availability of third-party apps, network services or optional features;
  • accessories shown on the Website may be optional or sold separately;
  • remote management, video calling, alerting or related functions may be model-dependent.

Customers should confirm compatibility and included items before purchasing a handset or associated service.

10. Safety, health and emergency information

This Website provides general product information only. It does not provide medical advice, health-care advice, clinical recommendations, personal safety monitoring or emergency response services.

A phone feature described as a trusted-contact shortcut, assistance button, alert option or similar feature is not represented by us as a monitored emergency service unless expressly confirmed in separate written product documentation.

Emergency assistance: in an urgent or life-threatening emergency in Australia, call Triple Zero (000) for Police, Fire or Ambulance.

Visitors should not rely on Website product descriptions as a substitute for emergency arrangements, professional medical advice or personal safety planning.

11. Customer feedback and testimonials

Customer feedback, ratings or testimonials published on this Website should represent genuine feedback that we are authorised to display. Testimonials may reflect an individual experience and do not guarantee that another customer will have the same experience.

Any demonstration text used during Website development must be removed or replaced with verified customer feedback before the Website is used as a live public-facing promotional site.

12. Privacy, cookies and browser storage

Our handling of personal information submitted through an enquiry, telephone call or other interaction is described in our Privacy Policy.

Information about essential browser storage, enquiry attribution and any analytics or marketing technologies used on the Website is described in our Cookies & Browser Storage Policy .

Please do not submit medical histories, diagnoses or other sensitive health information through the Website consultation form.

13. Intellectual property and permitted use of Website content

Unless otherwise stated, the Website design, layout, written content, graphics and original branding made available by us are owned by, or licensed to, Where2Where Mobility and are protected by applicable intellectual property laws.

You may view and print reasonable portions of this Website for your personal, non-commercial evaluation of our services. You must not, without our prior written permission:

  • copy, republish, distribute or commercially exploit Website content;
  • remove copyright, trade mark or proprietary notices;
  • use our branding in a way that suggests endorsement or affiliation;
  • scrape, reproduce or systematically extract Website content for commercial use.

Names, logos, product images or trade marks relating to third-party manufacturers, applications, carriers or accessory providers remain the property of their respective owners and may only be displayed where we have an appropriate right or permission to do so.

14. Third-party websites and external services

The Website may contain links to external websites or references to products or services provided by third parties. Such references are provided for information or convenience only.

We do not control external websites and are not responsible for their content, privacy practices, availability or terms. You should review the terms and privacy policies of any third-party service before using it.

15. Website availability, disclaimers and limitation of liability

We aim to keep the Website available and its information accurate. However, Website access may occasionally be interrupted, delayed, changed or unavailable due to maintenance, technical issues or matters outside our reasonable control.

To the extent permitted by law, we do not warrant that the Website will be uninterrupted, error-free or free from all harmful components, and we are not responsible for loss caused solely by reliance on unconfirmed Website product information where confirmation was reasonably required before purchase.

Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees, rights or remedies where doing so would be unlawful, including under the Australian Consumer Law.

16. Acceptable use

You must not use this Website to:

  • submit false, misleading, fraudulent or impersonated enquiries;
  • interfere with the Website, its forms, security or operation;
  • transmit malware, automated spam or harmful code;
  • harass, threaten or abuse staff or other persons;
  • collect data from the Website by unlawful or unauthorised means;
  • engage in conduct that infringes another person’s legal rights.

We may block access, reject a submission or take other reasonable action where we reasonably believe the Website is being misused.

17. Questions, concerns and complaints

For questions about the Website, a consultation enquiry, store contact or a purchased product, contact our team using the details below.

If you have a concern about a product purchased from the store, please provide details of the product, the issue and available proof of purchase so that the matter can be assessed.

These Terms do not prevent you from contacting an applicable consumer protection body or pursuing any right available under law.

18. Governing law

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from those courts.

This clause does not restrict any statutory right a consumer may have to bring a matter in another jurisdiction where applicable law permits.

19. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Website, consultation process, store operations or legal obligations. The current version will be published on this page with an updated revision date.

Changes to these Website Terms do not remove consumer rights that apply to an existing purchase under applicable law.
